Individuals with severe mental illness face significant challenges in navigating the legal system which can result in unjust outcomes. Severe mental illness can prevent an individual from understanding the workings of the criminal justice system, communicating with legal counsel, and making informed decisions. In addition, access to appropriate treatment may be limited, leading to worsening mental illness and unnecessary suffering. Legal professionals are often unprepared to work with these individuals. They rely on mental health professionals, especially psychologists, to identify them and help answer important legal questions. 

Roles of Forensic Psychologists in Criminal Cases

  • Competency Evaluations: Individuals have a constitutional right to know the charges against them and defend themselves with the assistance of competent legal counsel. Competency evaluations identify individuals who have a mental illness, developmental disorder, or cognitive impairment that prevents them from understanding the legal proceedings or assisting in his defense.  
  • Mental Health Screenings: Early identification of mental health issues is vital in the pretrial phase. Forensic psychologists in the criminal justice system can collaborate with legal professionals to implement mental health screenings for all defendants. These may be used to identify individuals who would benefit from different diversion programs, inform decisions about release on bond or parole, recommend specific treatments, inform legal strategy, and assist defendants in communicating with legal counsel and the Court. 
  • Conditional Release Plans: Forensic psychologists can help design individualized treatment plans for defendants with severe mental illness. These plans address their unique needs, such as medication management, therapy, and support services that maximize the likelihood of positive outcomes increases while reducing the risk of recidivism 
  • Consultation for Legal Professionals: Forensic psychologists in the criminal justice system can serve as valuable resources for legal professionals, providing expert insights into the complexities of severe mental illness. They can help attorneys better understand their clients’ conditions, enabling more effective communication and collaboration, resulting in fairer legal representation. 
  • Recommending Accommodations: Forensic psychologists can identify appropriate accommodations for individuals with severe mental illness that can be applied to legal procedures and court hearings. This may include providing a quieter environment, allowing for breaks during proceedings, or using alternative communication methods to ensure effective participation.
